Man admits to consuming multiple mixed drinks before going over double the blood alcohol limit in East Nashville – Alexander McMillan – Scoop: Nashville


Alexander McMillan, 22, was jailed in Metro Nashville jail early Saturday morning after hitting a blood alcohol level of 0.174, more than double the legal limit in Tennessee, after a traffic stop in East Nashville . Metro police said he was traveling at 42 in a 30 mph zone and crossing marked lines on the roadway before failing to stop at a stop sign on Eastland Avenue & Riverside Drive. McMillan admitted to drinking three mixed drinks before driving. He is accused of drunk driving and is free on bail.

ARREST WARRANT / AFFIDAVIT:
On 04/12/2021, at around 0022 hours, I observed a white vehicle driving in front of me on Eastland which appeared to be traveling above the posted speed limit and saw it cross the double yellow line on Eastland Avenue and Chapel Avenue. Saw the vehicle cross the double yellow line twice again between Porter Road and Riverside Drive with its tires on the left side, the vehicle failed to come to a full stop at the stop sign at Eastland Avenue and Riverside Drive.

I was behind the vehicle and it crossed the solid white line on the left side of the road and was traveling at 42 mph in a posted speed zone of 30 mph. I triggered a traffic stop and the vehicle took a long time to stop. I made contact with the driver and while talking to him I could smell the obvious smell of an alcoholic drink coming from his breath and himself, his eyes were bloodshot and watery, and he admitted to drinking three mixed drinks.

Based on the observed driving, indicators of impairment observed during my personal contact and his admission of alcohol consumption, I requested that he perform sfst which he agreed to do. The suspect was taken into custody for impaired driving based on observed driving, indicators of impairment observed in my personal contact, several indicators of impairment observed on each of the sfst and his admission to having consumed all three mixed drinks.

He read Tennessee’s implied consent law and initially refused a breathalyzer test, but then consented to a breathalyzer test and the results were 0.174 g / 210 L.
